Job Title: JR006541 Head of Legal & Compliance - DACH

Location: Düsseldorf, Germany (hybrid)

Job Description

As Head of Legal & Compliance - DACH, you will ensure that the company functions in a legal and ethical manner that is true to its mission and core values by maintaining high levels of business integrity and compliant ways of working.

Key Responsibilities
  • Serve as a trusted strategic advisor to the General Manager and other members of the Senior Leadership Team in the DACH cluster and other assigned markets as may be required from time to time
  • Responsible for the day-to-day legal and compliance matters in assigned markets across all business units (prescription (Rx), aesthetics (Ax) and consumer (Cx)) and enabling functions.
  • Represent and articulate the needs / requirements / differences of assigned markets within the Global Legal and Compliance Function, working closely with the Global, Regional and other country-level legal and compliance colleagues to ensure consistent, strategic, reliable, and solutions-oriented support to enable the Galderma business while protecting company assets and reputation.
  • Facilitate training and provide advice with regards to corporate policies, codes of conduct, and applicable rules and regulations including promotional compliance, GDPR and other data privacy requirements, trade sanctions, transparency reporting, third party due diligence, ABAC compliance.
  • Employ a pragmatic commercial mindset to effectively balance opportunities and risk, thereby enabling and facilitating a wide range of business opportunities in line with the company's ambitious growth strategy while remaining within the boundaries of the law.
Specific responsibilities include:

  • Member of the German affiliate senior leadership team helping to drive performance and building a culture of accountability, and cooperation.
  • Provision of advice on laws, regulations and guidelines applying to the pharmaceutical, aesthetic and consumer industries with a focus on the commercialisation of medicines, medical devices and cosmetics within the assigned markets.
  • Navigation of grey areas and effective education on and raising awareness of legal and compliance boundaries within an evolving legal and regulatory framework and growing business.
  • Data Privacy Advocate in assigned markets for Galderma's Data Privacy Program (GDPR / Federal Data Protection Act).
  • Supporting Galderma's nominated Company Secretariat with local corporate law and company secretarial matters for designated legal entities within the Galderma group to the extent needed.
  • Drafting and / or reviewing various agreements, including consultancy, advisory boards, wholesaler and distributor arrangements, procurement of goods / services, collaborations and grants / sponsorships; development of fit-for-purpose Standard Operating Procedures (SOP) and Work Instructions (WI) that apply to activities and engagements undertaken across the company and various business units.
  • Supporting procurement activities including vendor assessment and Request for Proposal (RFP) activity.
  • Leading essential audit, investigation, monitoring and risk assessment activities; proactively seeking to address risks and gaps identified and implementing processes and policies as required.
  • Identification, development and roll-out of training programs across the assigned markets ensuring relevant staff are fully conversant with the appropriate regulations, industry codes and standards.
  • Direct risk management review of promotional, educational, marketing, and company disclosure materials to be disseminated locally.
  • Effective management, investigation and response to complaints, litigation matters.
  • Efficient and timely management of litigation matters; supporting Human Resources where required in employee relation matters (including investigations; disciplinary processes).
  • Management of external counsel engagements, instructions and spend and overseeing delivery of work matters assigned to counsel.
  • Manage the budget efficiently in collaboration with the regions and the markets.
Skills & Qualifications

  • Qualified to practice law in an EU member state. Extensive years of (legal) professional related work-experience in Germany.
  • Combination of private practice and regional in-house legal roles in a healthcare industry environment; a proven record of performance and management.
  • Proven proficiency and experience with relevant pharmaceutical / healthcare promotion related and legislation, regulation, and standards as well as relevant industry codes of practice within the assigned markets.
  • German native speaker, excellent English language skills (additional languages are a plus).
  • Strong proficiency in Microsoft Word, Excel, PowerPoint, and Outlook.
