The Legal & Compliance Officer will be responsible for providing support on, and ensuring compliance with, Compliance, Legal, and Privacy matters in France. You will also be responsible for supporting certain cross border matters, including initiatives with a French element, such as mergers and acquisitions, group-wide policies.

Key Responsibilities:

1. Ensure French Compliance (Anti-gift law, Transparency)
  • Key point of contact for Convatec France (and global) to ensure that all interactions with Healthcare professionals are in full compliance with French law, regulation and guidance.
  • Provide answers and advice on regulations and procedures to be followed and make recommendations;
  • Support the Assistants to perform the administrative formalities regarding pre declarations on EPS and IDAHE 2 Platforms and post declarations (publication) on the Transparency website, in accordance with the established calendar;
  • Ensure the compliance of submitted requests (local and global);
  • Follow-up and manage authorities' feedbacks (recommendations, requests for supplements, refusals);
  • Translate contracts when it is needed;
  • Participate to meetings with the Business on current and future projects;
  • Take part of meetings, seminars held by the Trade Union ("Snitem");
  • Conduct audits on third parties and on CVT employees which are performing contracts and pre & post delcarations on Laboratoires Convatec's behalf and makes sure rules are respected;
  • Draw up corrective action plans + provide training in the event of errors;
  • Manage a digitalised process for reporting compliance risks.
2. Commercial contracting
  • Draft various legal documents, including: service contracts, agreements for clinical studies, consulting contracts, booth contracts, sponsorship agreements, donation contracts, contracts relating to social media etc.
  • Review and consider all contracts which are relevant for the purposes of French Anti-gift law including contracts with Healthcare professionals, influencers, hospitals and others providing training for healthcare professionals
  • Provide input into global contracts with French elements (e.g. governing law or contractual counterparty)
  • Preparing and reviewing contract templates
  • Ensuring proper management and storage of contracts
3. Manage legal activities
  • Lead the French Risk Committee every 3 months with business unit Directors and Executive Directors of Laboratoires Convatec;
  • Be the contact point in France for matters related to Intellectual Property;
  • Support training of new employees on French legal and compliance matters;
  • Carry out declarations to authorities and hospitals: Bnf, Biomed, AP-HP;
  • Follow the implementation of the Professional Practices Charter and put in place a SMQ with Regulatory, SFE, HR;
  • Supporting risk management and reporting risks;
  • Support on any mergers and acquisitions with a French element including post integration support; and
  • Assist the global ESG team on various matters.
4. Assume the role of "Compliance Champion"
  • Assist teams with Group Compliance formalities (via Medcompli and Steele tools);
  • Check the identity of third parties with whom we wish to contract or have interactions with and assist with any subsequent audit / actions to be taken;
  • Review SOPs at the initiative of the Compliance team;
  • Act as a "Compliance Champion" by participating in meetings, transferring information between the Global Compliance Team and local teams;
  • Ensure the training of new employees and all employees having interactions with a French HCP, HCO or any party concerned about the anti gift law and the Medtech Code.
5. Assume the role of "Privacy Champion"
  • Provide advice on privacy matters to local and European teams;
  • Act as a "Privacy Champion" by participating in meetings, transferring information between the Global Privacy Team and the local teams;
  • Support teams in completing the ROPA and OnesTrust forms to conduct risk analysis;
  • Reviewing SOPs at the initiative of the Privacy Team;
  • Support local team regarding GDPR matters but also bring to the attention of the Privacy team the French specificities from the French data protection authority (CNIL); and
  • Take part of the Regular Catch up with Privacy, Legal and Compliance (Global team).
6. Be the "legal" validator of promotional and institutional tools
  • Carry out the "L" review via Compass tool;
  • Be force of proposal in case of inadequate claims;
  • Monitor and update the claims file; and
  • Ensure the training of new employees on the MRL process
Skills & Experience:
  • You are qQualified to practice law in France or Senior Paralegal with 5 years plus of experience in the industry.
  • You have at least 3 years of experience in a similar role in a life sciences/medical devices company.
  • You have knowledge of the relevant legislation (Medtech Code, anti-gift law, MDR, GDPR, etc.) and are familiar with the French authorities' platforms (EPS- IDAHE 2- Transparency website).
  • Technical excellence as well as a high degree of integrity are must-haves for the role. Curiosity, agility and flexibility, great organisational skills and rigor are critical for success.
  • Your interpersonal skills allow you to interact with a wide variety of internal and external stakeholders at all levels of seniority. The role interacts on a frequent basis with Senior Directors and VPs and an ability to influence and be heard is important.
  • You are able to work on several subjects at the same time and have a good sense of how and when to prioritise.
  • You are action and solution oriented.
  • Your interpersonal skills allow you to interact with a wide variety of internal and external stakeholders at all levels of seniority. The role interacts on a frequent basis with Senior Directors and VPs and an ability to influence and be heard is important.
